investors and professionals July 1999 Avoiding INS border abuse Attorneys have a limited role to play if INS wants to impose its will on an incoming traveller. As such, it is essential that all travellers retain documents to prove their residence in their home country, if the visit is temporary to the U.S. If the traveller is a resident of the U.S. and has been away for more than ONE MONTH, then the traveller should carry proof of his or her residence in the U.S. upon their return. Hassles at the airport If the traveller is interrogated at the airport or land border crossing port, the attorney may be allowed to speak to the supervisor to determine the issue but no resolution of the issue will be made at that point if INS is convinced that a fraud has been perpetrated. The next step is the District Director who will oversee the determination of the charge. This could take weeks or months depending on the complexity of the matter. Reporting INS abuse Travellers who have been abused but who are in lawful status should take measures to reinstate their status and file a complaint with appropriate government authorities both in the U.S. and abroad. A foreign consul will be very interested in knowing why someone from their jurisdiction has been intercepted. Multinational Companies Move to America The U.S. economy is growing very quickly. Unemployment is down to 4.8% nationally. Small wonder why so many foreign companies are moving to America. Most companies begin their market penetration by sending key employees to establish banking, accounting, finance and government relations. Being able to communicate in the language of client`s choice is essential to success. Speed and certainty of market penetration will give the client a significant advantage. Revalidation of visas by mail Certain existing visas, such as an E2 investor visa, may be revalidated by mail through the State Department in Washington DC. Although the documentation is extensive, this option may prevent a return trip to the applicant`s home country. The selection of any professional advisor should not be based solely on advertisement.
